Hawk Notes: Texas A&M seeks injunction

Seattle Times staff reporter

The Seahawks and Texas A&M University might yet have their day in court.

The NFL team and the university are scheduled for a preliminary injunction hearing on May 18 in district court in Houston, although the location is being challenged by the Seahawks. If the injunction is granted, the Seahawks would be barred from using the 12th Man slogan until Texas A&M's trademark infringement case against the NFL team is resolved in court.

The case might never reach a courtroom, though, as the sides are working to resolve the matter without a trial.

The university began using the 12th Man theme in 1922 and trademarked it in 1990. The Seahawks retired No. 12 in 1984 and have played up the 12th Man in recent years.

Texas A&M asked the district court for a temporary restraining order before the Super Bowl to keep the Seahawks from using the words. The Seahawks then filed a change-of-venue motion.

If the case goes to court, the Seahawks hope hearings will be in the Seattle area and not in Houston. The college is located in College Station, about an hour and a half from Houston.

Texas A&M has until Tuesday to respond to the Seahawks' change-of-venue motion. The Seahawks then would have until April 10 to reply to that response.

Notes

• The deadline for the Minnesota Vikings to match the Seahawks' seven-year, $49 million offer sheet for WR Nate Burleson arrives this afternoon. The Vikings are not expected to match or challenge the guarantee provisions in the offer sheet.

• Seahawks QB Matt Hasselbeck and a few of his teammates will throw out the first pitch at the Mariners' opener Monday at Safeco Field.

• The Mariners aren't the only Seattle team recognizing the Seahawks' Super Bowl run. Defensive end Grant Wistrom will be at KeyArena on Saturday night to drop the ceremonial first puck before the Thunderbirds' playoff game against the Portland Winter Hawks.

• Receiver Skyler Fulton, an Olympia native under contract with the Seahawks, posted his second straight 100-yard game with five catches for 105 yards for Amsterdam of NFL Europe. That included a 65-yard touchdown reception in the Admirals' win at Cologne. Fulton has 11 catches for 236 yards and two touchdowns in two games.
