Former surgeon accused in fatal Waukesha County crash returned to jail after home searched

A former surgeon accused of killing a pregnant woman and her daughter in a drunken driving crash was returned to Waukesha County Jail Wednesday after being charged with two counts of bail jumping for violating conditions of his release.

A former surgeon accused of killing a pregnant woman and her daughter in a drunken driving crash was returned to Waukesha County Jail Wednesday after being charged with two counts of bail jumping for violating conditions of his release.

Investigators said Mark Benson was purchasing prescription drugs from a company in Florida and having them delivered to his town of Summit home, in violation of his bond that allows him to have only the drugs prescribed for him by a physician and filled at a local pharmacy.

The Waukesha Metro Drug Unit said the home was searched Tuesday night after a delivery.

Benson was released from jail last month after Circuit Judge J. Mac Davis reduced his bond from $1 million to $500,000 and someone posted that amount for him.

His bond was raised Wednesday by $150,000.

Benson is accused of taking a mix of prescription drugs before his SUV slammed into a car in Oconomowoc last April 25.

Killed were 39-year-old Jennifer Bukosky, her fetus and her 10-year-old daughter. Two other children were injured. Bukosky was associate principal of Oconomowoc High School.

Records show the 56-year-old Benson was convicted of operating while intoxicated for a third time and had his driver's license revoked two days before the crash.

Charges in the crash include two counts of homicide by intoxicated use of a vehicle. His trial is scheduled July 13.

A preliminary hearing on the bail jumping charges is scheduled April 2.
