A lawyer for Christopher Monfort has asked a King County Superior Court judge to issue a subpoena for a Seattle Times reporter's notes of two interviews with Monfort.
In a court filing earlier this month, defense attorney Julie Lawry wrote that the notes were essential because she believed the reporter, Jonathan Martin, would likely be called as a witness for the prosecution.
In a court filing on Friday, Eric Stahl, an attorney for The Seattle Times, opposed the request, citing the state's 2007 "reporters' shield law," which limits the ability to subpoena a journalist's notes.
Stahl termed Lawry's concern about Martin being called as a witness "baseless speculation, which is insufficient to overcome the privilege. In any event, the State has indicated no intent to call Martin as a witness — and if it did, Martin would resist, on the same grounds."
Martin interviewed Monfort twice at the King County Jail after he invited the reporter to visit him.
