BILLINGS, Mont. —

A former Billings school bus driver accused of hitting a high school student with the bus while driving drunk will be returned to Montana to face charges.

Timothy Joseph Whalen agreed Friday in Ferry County Superior Court in Colville, Wash., to waive extradition proceedings and be returned to Montana, where he faces charges including negligent vehicular assault.

Yellowstone County prosecutors allege Whalen had a blood alcohol content of 0.118 two hours after the bus he was driving hit a 15-year-old girl in a crosswalk Sept. 25 in Billings. The girl suffered a broken leg.

Whalen was arrested Nov. 4 in northeastern Washington near the Canadian border by a trooper investigating a report of erratic driving.
