Lethal injection trial nearing end in Olympia

OLYMPIA, Wash. —

Closing arguments are under way in a civil trial challenging Washington's method of lethal injection as a death penalty.

Three death row inmates say the state's lethal injection system is unconstitutionally cruel, because it can't ensure the condemned inmate will be totally unconscious when fatal drugs flow into their veins.

But state lawyers say the Department of Corrections' method is substantially similar to the system upheld by U.S. Supreme Court in a Kentucky case. Thurston County Superior Court Judge Chris Wickham could take several days to rule.

The three death row inmates in the lawsuit are Darold Stenson, who shot his wife and business partner in Clallam County; Cal Coburn Brown, who tortured a Burien woman to death; and Jonathan Gentry, who killed a 12-year-old girl in Kitsap County.
