State AG: Nickels can't ban guns on public property

Washington State Attorney General Rob McKenna issued a legal opinion Monday saying Seattle Mayor Greg Nickels does not have the authority to prohibit guns on public property.

State Attorney General Rob McKenna issued a legal opinion Monday saying Seattle Mayor Greg Nickels does not have the authority to prohibit guns on public property.

The opinion, which was requested by state legislators, is nonbinding. Historically, though, such opinions been given great weight, according to the Attorney General's Office.

After three people were injured in a May shooting at Seattle Center's Northwest Folklife festival, Nickels started drafting an administrative rule to prohibit guns on all city property, including buildings, parks and community centers.

According to the attorney general's opinion, Washington state law "preempts a city's authority to enact local laws that prohibit possession of firearms on city property or in city-owned facilities."
