Jury selection expected to resume in Duncan case

After a delay that lasted more than three months, lawyers are poised to continue putting together a jury in the sentencing phase of Joseph Edward Duncan's capital murder case.

BOISE, Idaho —

After a delay that lasted more than three months, lawyers are poised to continue putting together a jury in the sentencing phase of Joseph Edward Duncan's capital murder case.

U.S. District Judge Edward Lodge suspended jury selection in late April after Duncan sought to dump his legal team and serve as his own lawyer.

The judge ordered a series of mental health evaluations, deemed Duncan competent and under strict guidelines has consented to Duncan's request.

Prosecutors, defense lawyers, Duncan and dozens of potential jurors are expected to return to the federal courthouse in Boise Wednesday morning.

Duncan is facing the death penalty after pleading guilty to 10 federal charges in the high profile 2005 kidnapping of two north Idaho children and the murder of one of them.
