The King County Prosecutor's Office has declined to charge Ann Marie Gordon, the manager of the state toxicology lab who was accused of falsely certifying quality-assurance samples used in DUI breath-testing.

The office said today there is insufficient evidence to support a criminal charge. It said there is no evidence that Gordon's conduct compromised the accuracy or reliability of the testing.

Since Gordon resigned in July and there has been no public harm, the office said there is little to be accomplished by any criminal prosecution.

Gordon's behavior figured in arguments from defense lawyers who have said that problems in the state lab were reason to throw out drunken-driving charges.
