Judge dismisses charge against defendant's son
A federal judge has dismissed a charge against the son of a Texas man accused of swindling investors from North Dakota and elsewhere out of millions of dollars.

A federal judge has dismissed a charge against the son of a Texas man accused of swindling investors from North Dakota and elsewhere out of millions of dollars.
Byron Swartzendruber was charged with one count of conspiracy to defraud the United States.
Judge Ralph Erickson dismissed the charge Thursday at the request of prosecutors who said Swartzendruber had completed a pretrial diversion program. It allows some criminal cases to be settled without a plea if the defendant meets certain conditions.
Swartzendruber's father, Verlin, of Laredo, Texas, has pleaded not guilty to 11 felony counts. His trial is scheduled next summer.
Minot commodities broker Frederick Keiser Jr. was convicted earlier in the case and sentenced to 12 years in prison.
